Sometimes, the most valuable thing an expert witness can provide is a reality check.
I had a call the other day with a litigator and their client. The day before, the lawyer had sent me a brief summary of their case as they were considering retaining me as an expert witness.
The conversation lasted only 15-20 minutes, but in that time, I was able to offer some key insights. Their theory hinged on the idea that a private mortgage lender was somehow tied to an embezzlement scheme. After reviewing the facts, I explained why that argument likely wouldn’t hold up: the lender’s actions aligned with what any typical equity lender would do in a similar scenario. There was no real indication they were part of any conspiracy.
Not the answer they were hoping for, but that’s the role of an expert witness: to provide an informed, unbiased opinion. That brief consultation helped them avoid investing time and money into a claim that wasn’t supported by the facts.
Hopefully, they can now refocus their efforts and pursue a stronger case against the party truly at fault.
